Heard Sri Sameer Kumar Rai, Advocate holding brief of Sri Gaurav Gautam, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
Present petition has been filed with the following prayers:-
"(i) Issue a writ, order or direction in the nature of mandamus commanding the respondent nos. 2 & 3 to consider the claim of the petitioner for the award of armed license in pursuance to the application submitted by the petitioner as per application no. 12. of 2019."
Learned counsel for the petitioner submitted that earlier petitioner had filed an application for grant of armed licence in the month of December, 2019, which was numbered as Application No. 12 of 2019 before the respondent no.2, but till date no decision has been taken upon that. He next submitted that a suitable direction may be issued to respondent no. 2 to decide the aforesaid application of the petitioner at the earliest.
Learned Standing Counsel for the respondents submitted that his application shall be considered and decided strictly in accordance with law within stipulated period.
Considering the facts and circumstances of the case, this writ petition is disposed of with direction to respondent no. 2 to decide the application of the petitioner strictly in accordance with law within a period of six weeks from the date of production of computer generated copy of this order after verifying the same from official website of Allahabad High Court.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 2 to decide the application of the petitioner after considering the relevant Acts, Rules, Government Orders, Judicial pronouncement made by the Court as well as facts of the case.
