Heard learned counsel for the petitioner and Sri Sujit Kumar Rai, learned counsel appearing for the respondents.
Present writ petition has been filed for a writ of mandamus directing the respondents to extend the preferential benefit to the petitioner in forthcoming selection proceeding on the post of Assistant Engineer (Civil) in Uttar Pradesh Rajya Nirman Sahkari Sangh Ltd.
Sri Sujit Kumar Rai, learned counsel appearing for the respondents has informed that first of all there is no provision or rule which provides any preferential benefit as claimed by the petitioner and secondly as on date, there is no advertisement for the recruitment on the post of Assistant Engineer (Civil) and petition is premature.
Learned counsel for the petitioner has not disputed this fact that there is no advertisement issued by the respondents for selection on the post of Assistant Engineer (Civil).
Therefore, in light of undisputed facts, the writ petition is premature and, accordingly, dismissed at this stage.
