At the very outset, learned Standing Counsel has raised a preliminary objection with regard to maintainability of the present writ petition. It has been contended by him that the petitioner has got an alternative remedy against the impugned order dated 09.07.2019 to file an appeal before the Commissioner concerned.
The learned counsel for the petitioner has not disputed the aforesaid contention made by the learned Standing Counsel.
In view of the above, this writ petition is dismissed as not maintainable on the ground of alternative remedy.
However, if the petitioner prefers an appeal within a period of 15 days from today, it shall be entertained and decided by the appellate authority ignoring the period of limitation.
