Heard Sri Brijesh Kumar Sharma, learned counsel for the applicant, Sri Suraj Singh, learned A.G.A. appearing for the State and perused the record.
This application under Section 482 Cr.P.C has been moved with a prayer to direct the court below to decide the S.T. No. 880 of 2018 (State vs. Gaurau Kumar and others) arising out of case crime no.705 of 2018 under sections 302, 201, 114 IPC, Police Station Kotwali Nagar, District Muzaffar Nagar.
It is argued by the learned counsel for the applicant that the applicant is an accused in this case. The charge has been framed in this case on 11.12.2018 since thereafter only one witness was examined but his statement has not been concluded. Therefore, he has made a prayer before this Court through present application praying that a direction be issued to the trial court to decide the case expeditiously.
It is directed that the court below shall make all endeavour to decide this case expeditiously preferably within a period of one year from today, if there is no legal hurdle, without permitting undue adjournments to either side.
With this direction, this application is disposed.
