Sri M.N. Singh, learned counsel appearing for the U.P. Public Service Commission has not only filed counter affidavit but has also produced the answer books of the paper General Hindi of the petitioner of the APO Examination - 2015.
The writ petition as filed is based on the allegation that the petitioner has been awarded Zero marks in the questions No.6, 7 and 10 of said paper.
The answer sheet reveals that the averment so made is incorrect. The petitioner has been awarded 3, 4 and 5 marks out of 10 in the above questions. The answer book produced by the Commission also establishes it. This is also the stand taken in counter affidavit.
In view of the above, the ground on which the writ petition has been filed stands falsified leaving no merit in it. It is accordingly, dismissed.
