Heard learned counsel for the applicant, learned AGA and perused the record.
By means of instant transfer application a prayer sought that the matter should be transfer from Bijnor to any other district so far as it relates to Criminal Case No. 1541 of 2018 (State Vs. Gaurav Kumar) under sections 406, 506 IPC, P.S. Haldaur, District Bijnor, pending in the Civil Judge (Junior Division)/Fast Track Court/ Judicial Magistrate, Bijnor arising out of case crime no. 322 of 2016.
Submission made by the counsel for the applicant that the opposite party no. 2 is a practicing lawyer in the Civil Court, Bijnor and he has moved a case under sections 406, 506 IPC against the applicant. It is further submitted that in paragraph 7 of the petition it has been mentioned that the opposite party no. 2 is a practicing lawyer in Civil Court, Bijnor and he extended threat to the applicant that he would send the applicant behind the bar. The case is of law and order.
Under the circumstances, the S.P., Bijnor is directed to look into the matter and pass a suitable order within 15 days from today.
With the aforesaid direction, the present transfer application stands disposed of.
