Heard learned counsel for the petitioner and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondent no.1-Sub Divisional Officer, Tehsil Burhanpur, District Azamgarh to decide the restoration application no. T201915060600499 filed in Case No. T2019150600499 filed under Section 21/24 of U.P. Land Revenue Code, 2006 situated in village Baraipur, pargana Atrauliya, Tehsil Burhanpur, District Azamgarh within stipulated time.
The contention of learned counsel for the petitioner is that the recall application dated 20.12.2018 was filed by a stranger, who is not the party in the proceedings. It is further contended by learned counsel for the petitioner that unnecessarily the matter is being pending although the application filed at the instance of stranger is not maintainable even he is not the aggrieved person.
Under these circumstances,respondent no.1-Sub Divisional Officer, Tehsil Burhanpur, District Azamgarh is directed to decide the restoration application no. T201915060600499 filed in Case No. T2019150600499 filed under Section 21/24 of U.P. Land Revenue Code, 2006 as expeditiously as possible preferably within a period of three months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
