DAMODAR COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to direct the release of the petitioner on bail in the event of his arrest in connection with the Crime No.139 of 2013 on the file of the W.P.S., Karimnagar, pending investigation and trail of the cases.
The Court made the following Order:
“This Criminal Petition is filed under Section 438 Cr.P.C. seeking anticipatory bail to the petitioner–A1 in connection with Cr.No.139 of 2013 of Women Police Station, Karimnagar District, registered for the offence punishable under Section 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act.
Heard the learned counsel for the petitioner and the learned Public Prosecutor for the Respondent-State.
The private complaint, which has been lodged under Section 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act, prima facie reveal that it was filed after the legal notice dated 11.06.2013 issued by the petitioner and also after receipt of the notice in O.P.No.93 of 2013.
Petitioner is a Government Teacher and his arrest in connection with the matrimonial dispute would result in losing his job. In those circumstances, I am inclined to grant anticipatory bail to the petitioner.
Accordingly, the Criminal Petition is allowed and the petitioner shall be enlarged on bail in the event of his arrest on condition of his executing a personal bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a like sum each to the satisfaction of the Station House Officer, Women Police Station, Karimnagar District.”
