Heard Sri Vikas Srivastava, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner in the writ petition is seeking a direction to the respondents no. 1 to 4 to restrain the respondents no. 5 to 7 from raising any construction over Gata no. 19 area 13 biswa and Gata no. 15 area 0.280 hectare situate at Mohalla Bheri Khana, Tehsil Sadar, District Banda. According to the petitioner, he has represented before the City Magistrate through an application dated 14.1.2019, annexure-3 to the writ petition, on which a direction was issued to the Tehsildar as well as the Station House Officer to inquire into the matter and take action immediately if there is any illegal construction over the said Gatas and submit a report.
The grievance of the petitioner is that no action has been taken by the respondents no. 1 to 4 till date.
Learned Standing Counsel is directed to obtain instructions in the matter.
