Respondent Petition under Section 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to release the petitioners/Accused No. 1 and 2 on bail in Cr.No.51 of 2014 of Bhupalpally Police Station, Warangal District pending enquiry and trial.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri P.Prabhakar Reddy, Advocate for the Petitioners and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“The petitioners are A-1 and A-2. They seek for grant of bail. They allegedly committed offences under Sections 489-B and 489-C IPC.
It is the case of the prosecution that A-3 was apprehended when he was in possession of 76 counterfeit currency notes of hundred-rupee denomination and that on his confessional report, A-1 and A-2 are brought into this case.
It is the case of the learned counsel for the petitioners that no counterfeit currency notes were seized from the possession of A-1 and A-2 and that the case was merely on the basis of the confessional statement of A-3.
In view of the nature of the counterfeit involved and in view of the defence of the petitioners, I consider it appropriate to enlarge the petitioners on bail.
Consequently, the Criminal Petition is allowed. The petitioners-A1 and A2 are enlarged on bail on a personal bond of Rs.10,000/- (Rupees ten thousand only) each with two sureties in a likesum each to the satisfaction of the Judicial First Class Magistrate, Mulugu, Warangal District.”
