This correction be made prior to the issuance of the certified copy of this order.
Heard learned counsel for the petitioner and learned Standing counsel for the State-respondent.
The petition has been filed seeking the following relief-
"(I) A writ, order or direction of appropriate writ of mandamus/ order of directing to the respondents no.2 (i.e. to Sub- Divisional Magistrate, Tehsil-Shahganj, District- Jaunpur) to decide the pending Suit No.T20161436011951 (Purushottam V. Gaon Sabha) filed under Section 201/122 of U.P. Revenue Code, 2016, as expeditiously as possible i.e. within a specified time schedule that may humbly be fixed by this Hon'ble Court."
The contention of counsel for the petitioner is that a declaratory suit under Section 229B of the U.P.Z.A. & L.R. Act, filed by the respondent no.3 is pending before the respondent no.2, consequent to an order of remand passed by the Additional Commissioner in the year 2002.
Under the circumstances, this writ petition is disposed of directing the respondent no.2, Sub- Divisional Magistrate, Tehsil-Shahganj, District- Jaunpur to endeavour to decide the suit, positively, within a period of three months from the date a certified copy of this order is filed before him.
In case, necessity arises, the respondent no.2, Sub- Divisional Magistrate, Tehsil-Shahganj, District- Jaunpur, may hear the matter on a day to day basis so as to pass final orders, within the time specified above.
