JUDGMENT / ORDER

Court No. - 67
Case :- HABEAS CORPUS WRIT PETITION No. - 667 of 2019 Petitioner :- Ganpati Nath Tiwari And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ved Byas Mishra Counsel for Respondent :- G.A.,A.B.N.Tripathi
Hon'ble Rahul Chaturvedi,J.
Counter affidavit filed by learned A.G.A. today in the Court is taken on record.
Heard learned counsel for the petitioners, learned counsel for the respondent as well as learned A.G.A.
Pursuant to the earlier order of this Court dated 12.09.2019, both the girls namely Km. Vaishnavi and Ms. Ankita Tiwari are present in the Court.
The Court has got an opportunity to have conversation with the girls and this Court finds that the allegations made in the writ petition are absolutely canard. It is not expected from the father to make such baseless and defamatory allegations against her own daughter. By no stretch of imagination, it could be inferred that petitioner no.2 is in the illegal confinement of respondent no.3, who is her real elder sister. The allegation made by the father is unthinkable that the father of these girls would make ridiculous and abhorring allegation against his own daughters. It is rather shameless effort by the petitioner no.1, who himself has demean the institution of "Father", a protector of children by making sweeping and irresponsible allegations regarding character of her daughter.
Accordingly, the present habeas corpus petition stands dismissed.
