The Court made the following:
ORDER:
. Respondents This Writ Petition is filed for a Mandamus to direct respondent Nos.1 to 4 not to issue aquaculture certificate of registration in favour of respondent No.5.
The petitioner pleaded that he owns lands in the neighbourhood of the lands of respondent No.5 and that by forging the signatures of some of the neighbouring land owners, respondent No.5 has made an application for permission to convert his agricultural lands admeasuring Acs.15.00 in R.S.Nos.179/1B, 176/2A, 177/1, 175/1 and 174/1 of Toleru Village, Veeravasaram Mandal, Godavari District into aqua farms. The petitioner further pleaded that on coming to know about the same, he and five other neighbouring farmers made a representation to respondent No.2 on 06.08.2014 raising a serious objection for grant of registration of the above-mentioned land of respondent No.5 for aqua farming. He apprehends that the District Level Committee may grant permission to respondent No.5 without considering the objections filed by him and others.
After hearing the learned counsel for the parties, I am of the opinion that as no decision is stated to have been taken by the District Level Committee, West Godavari District, Eluru so far on the application of respondent No.5, it is appropriate that the said Committee considers the objections of the petitioner and others, stated to have been made on 06.08.2014, before taking a decision on the application of respondent No.5.
Accordingly, respondent No.2 is directed to ensure that the objections of the petitioners and other neighbouring farmers are considered by the District Level Committee, West Godavari District, Eluru before taking a decision on the application of respondent No.5 for registration of his land for aqua farming.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.39536 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
