Ganibhai vs State

High Court Of Gujarat|10 May, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Mr.Pandya, learned APP waives service of notice of Rule.
By way of this application, the applicant - convict has prayed that he be enlarged on temporary bail on the ground of his own medical treatment. Along with the application, the medical certificate of the Medical Officer, Central Jail Dispensary, Ahmedabad dated 7.5.2012 is annexed, where from it transpires that the applicant - convict is regularly being treated by the Doctors at the Central Jail Dispensary as well as U.N. Mehta Institute of Cardiology & Research Centre.
Under these circumstances, discretion of enlarging the application - convict on temporary bail does not deserve to be exercised. However, before declining to do so, we direct the jail authorities to see that the applicant - convict is treated properly by the concerned Doctors.
Subject to the above direction, the application is rejected. Rule discharged.
