The wife who is the respondent in I.D.O.P.No.49 of 2015, on the file of Family Court at Madurai, seeks transfer of the same to the file of Principal District Court at Chengalpattu to be tried along with O.P.No.64 of 2015 filed by her seeking divorce.
2.The transfer is sought for mainly on the ground of convenience of the wife and for joint trial. The wife claims to be a resident of Kottivakkam, Chennai -41.Even in the Original Petition filed by the husband before Family Court, Madurai, she is shown to be a resident of Kottivakkam, Chennai-41.
3.Considering the convenience of the wife as well as the pendency of O.P.No.64 of 2015, on the file of Principal District Judge, Chengalpattu, this Transfer Civil Miscellaneous Petition is allowed and I.D.O.P.No.49 of 2015 is withdrawn from the file of Family Court, Madurai and transferred to Principal District Court, Chengalpattu to be tried along with O.P.No.64 of 2015 pending before it. The Family Court, Madurai is directed to despatch the records in I.D.O.P.No.49 of 2015 to the Principal District Court, Chengalpattu within a period of two weeks from the date of receipt of a copy of this order. Consequently, connected Miscellaneous Petition is closed. No costs.
