Heard Mr. A.K. Sachan, learned counsel for the applicants and the learned A.G.A. for the State.
This application under section 482 Cr. P. C. has been filed challenging the summoning order dated 19.12.2017 passed by the Metropolitan Magistrate, Court No. 2, Kanpur Nagar, in Complaint Case No. 203 of 2017 (Birendra Vs. Gangaram and others), under section 420 IPC, P.S. Chakeri, District Kanpur Nagar, as well as the entire proceedings of the above mentioned complaint case.
After some arguments, learned counsel for the applicants submits that the interest of justice shall be served, in case a direction is issued by this Court to the Court below to decide the bail application of the applicants.
In view of the submission made by the learned counsel for the applicants and considering the facts and circumstances of the case, it is directed that the Court below shall decide the bail application of the applicants expeditiously in the light of the observation made by this Court in the case of Brahm Singh and others Vs. State of U.P. and others reported in 2016 (7) ADJ 151.
With the aforesaid direction, the present application stands finally disposed of.
