N.Krishnan ...Respondent PRAYER: The Civil Revision Petition has been filed under Article 227 of the Constitution of India, to allow this revision petition and direct the learned Sub-Judge, Harur to number the application in I.A.SR.No.4673 of 2017 in H.M.O.P.No.59 of 2016 on the file of the learned Sub Judge, Harur.
For Petitioner : Mr.R.Neelakandan O R D E R According to the learned counsel for the petitioner, the petitioner has filed an application in HMOP.No.59 of 2016 before the Sub-Court, Harur. In the aforesaid petition, the petitioner has filed an un-numbered I.A.SR.No.4673/2017. The above said application was returned with an endorsement that how the said application is maintainable and for re-presentation one month time was granted by the Court below. Challenging the same, the petitioner has filed the present Civil Revision Petition before the court.
2. At this stage, this Court is inclined to direct the petitioner to re-present the said papers and to explain the defects pointed out by the Court below. Thereafter, the Court below is directed to consider the explanation submitted by the petitioner and if the Court below is satisfied, the same shall be numbered and maintainability of the application shall be decided by the court below.
3. With the above observations, the Civil Revision Petition is disposed of. No costs.
