Heard learned counsel for the applicant and learned A.G.A. for the State.
This application under Section 482, Cr.P.C. has been filed by the applicant praying for a direction to the Judicial Magistrate, Mirzapur to decide the new case No.4202 of 2017 (old case No.4415/2016), arising out of Case Crime No.0335 of 2016, under Sections 419, 420, 467, 468, 471, 120B, IPC, P.S. Madihan, District Mirzapur, within the stipulated period of time.
Submission is that the charge sheet was submitted in the trial in the year 2016 as yet even charges have not been framed.
The court below is directed to secure the presence of the accuseds and frame the charges within a period of three months from the date of production of a certified copy of this order before it.
