The petitioner is the regular permit holder in respect of the vehicle bearing registration No.KL-13 Z 1476 having validity till 30.12.2014. The vehicle of the petitioner has to be changed. The petitioner has already taken steps to replace the existing vehicle with stage carriage No.KL-13 AB 7576. The petitioner further submits that he has made application for replacement and he relies on Exts.P4 and P5 to substantiate the above case. The petitioner approached this court in an earlier occasion on a writ petition for issuance of clearance certificate in respect of his vehicle bearing registration No.KL-13 Z 1476 without insisting for surrender of existing regular permit. This Court as per Ext.P2 judgment directed the authority to consider the request made by the petitioner in that regard. It further appears that the clearance certificate was issued on 24.12.2013 and time in which the requisite vehicle within four months. The petitioner submitted Ext.P3 request before the Regional Transport Officer, Kannur for extension of time for replacement. W.P.(C) No.12276 of 2014 2 Having regard to the submission of the petitioner that the petitioner purchase the vehicle for replacement, I am of the view, the Regional Transport Officer shall consider the request submitted by the petitioner for replacement, even though the original replacement granted by the first respondent has been expired.
Accordingly, there shall be a direction to the respondent to consider and pass orders on Ext.P3 request made by the petitioner as expeditiously as possible. Till such orders are passed, no action should be taken for cancelling the permit.
The writ petition is disposed of as above.
