JUDGMENT / ORDER

Petitioner in the aforesaid writ petition is aggrieved with the non- consideration of the endorsement of the vehicle, the current records of which, has been produced before the respondent. Petitioner was earlier before this Court seeking clearance certificate in respect of the vehicle, which was originally endorsed in the permit. That was granted by judgment dated 8.4.2014 in W.P.(C)No.10480 of 2014. There was also a direction that the current records of the vehicle sought to be substituted, shall be produced within four months from the date of the judgment. The Secretary, RTA, in compliance of the judgment, issued clearance certificate on 3.5.2014. Petitioner ought to have produced the vehicle on or before 8.8.2014. However, the petitioner could produce the vehicle only on 4.12.2014. Petitioner submits that it is a brand new vehicle and the delay occurred only W.P.(C)No.34473 of 2014 -:2:-
due to the delay in constructing the body. In such circumstances, it is only proper that, without looking into the specified time granted as per the judgment, the petitioner's prayer for endorsement of the vehicle in the permit be considered and the same allowed, if the current records of the vehicle was produced on or before 4.12.2014. Writ petition is disposed off.
