JUDGMENT / ORDER

Petitioners are accused Nos.5 and 6 in Crime No.228 of 2014 of the Pariyaram Police Station for the offences punishable under Secs.143, 147, 148, 452, 427, 341, 323, 324, 326 and 307 r/w Sec.149 of the Indian Penal Code, are in custody from 09.06.2014 and seek bail.
2. Learned Public Prosecutor has opposed the application.
3. I have heard the learned counsel for the petitioners also.
4. The nature of allegations made against the petitioners and contentions the petitioners have raised have been discussed by me in the order dated 30.05.2014 in B.A.No.3139 of 2014 while rejecting the prayer of the petitioners for pre-arrest bail. Now the petitioners are taken to custody and questioned. The second petitioner is stated to be the Principal of the Pariyaram Medical College School. They are not reported to be involved in any other case. In the circumstance, I am inclined to think that their further custody is not required. Hence I am inclined to grant bail but subject to conditions.
B.A.No.4357 of 2014 2 Resultantly this application is allowed as under:
(i) Petitioners are granted bail in Crime No.228 of 2014 of the Pariyaram Police Station and shall be released, if not required to be detained otherwise on their executing bond for `25,000/- (Rupees Twenty Five Thousand Only) each with two sureties each for the like sum each to the satisfaction of the learned magistrate and subject to the following conditions:
(a) One of the sureties shall be a close relative of any of the petitioners.
(b) Petitioners shall report to the Investigating Officer as and when directed for interrogation.
(c) Petitioners shall not, during the period of this bail get involved in any offence.
(d) Petitioners shall not intimidate or influence the witnesses.
(e) In case of violation of any of condition Nos.(b) to (d), bail granted hereby is liable to be cancelled by moving application before the learned magistrate (until committal of the case if any, and thereafter before the learned Principal Sessions Judge concerned) as held in P.K Shaji Vs. State of Kerala (AIR 2006 SC 100).
