(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Learned counsel Mr.Umang Oza is present for learned counsel Mr.B.S.Patel, who appears for respondents No.1, 2 and 5. Respondents No.3 and 4 did not seem to have even cared to appear. Respondents No.6 to 11 are stated to be fictitious persons who could not be served. Therefore, learned counsel Mr.Pandya sought to proceed with the hearing of the petition in absence of respondents No.6 to 11 and delete them as respondents. In view of the averments made in the applications and the statement made on affidavit by respondents No.2, respondents No.1 to 4 are required to remain personally present before this Court. Learned counsel Mr.Oza submitted that warrants or fresh notices are not required to be issued to them and he and learned counsel Mr.Patel will see to it that they remain personally present before this Court for clarifying whether the statements made in the affidavit of respondent No.2 are fulfilled and complied with or not. Hence, S.O. to 7/11/2012 with a request to learned counsel for the respondents to see that respondents No.1 to 4 remain personally present before this Court tomorrow.
