This writ petition as been filed by the petitioner challenging an order passed in proceedings under section 122-B of the U.P. Zamindari Abolition and Land Reforms Act. Admittedly, the petitioner has an alternative remedy of filing a revision against the order impugned as provided under section 122B(4A).
Learned counsel for the petitioner submits that he has not availed the alternative remedy because he has been granted only a week's time to procure a stay order, failing which his pucca house in question shall be demolished.
Since the petitioner has statutory alternative remedy available to him, this Court is not inclined to interfere with the impugned order. The writ petition is dismissed.
However, in the interest of justice it is provided that the petitioner may file the revision along with a stay application within a period of 2 weeks from today, along with certified copy of this order, and for the said 2 weeks his house shall not be demolished.
