High Court Of Judicature at Allahabad|27 February, 2019

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 38036 of 2002 Petitioner :- Ganga Ram Rajput Respondent :- Zila Basic Shiksha Adhikari And Others Counsel for Petitioner :- S.B. Singh Counsel for Respondent :- C.S.C.,P.K. Sharma
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"(a) issue a writ, order or direction in the nature of certiorari quashing the order dated 13.05.2002 with regard to conditions imposed by the respondent no. 1 in respect of recovery of total amount of the salary already paid to one Smt. Reshmawati alias Smt. Vijay Luxmi from the salary of the petitioner, to stop of increment of the petitioner in the period of suspension as well as to provide increments to the petitioner in future of subject to satisfaction of working period of the petitioner for a period of one year.
(b) issue a writ, order or direction in the nature of mandamus directing the respondent no. 1 and other respondents not to interfere in the peaceful service of the petitioner in pursuance of the order dated 2.11.2000 passed by this Hon'ble Court in Civil Misc. Writ Petition No. 47501 of 2000, Ganga Ram Rajpoot Vs. Zila Basic Shiksha Adhikari Kannauj and others and further the respondent no. 1 may be direct to release the monthly salary of the petitioners regularly without any delay."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
