The present application under Section 439 Cr.P.C. has been filed seeking bail in FIR No.122 of 2020, under Sections 354, 323, 504, 506 IPC, Section 7/8 POCSO Act and Section 3(1)(w) SC/ST Act, Police Station Hargaon, District Sitapur .
It is alleged hat the accused-applicant grabbed the prosecutrix and touched her mis-appropriately and when it was objected, she was given blows.
Learned counsel for the accused-applicant submits that the present FIR is a counter blast of filing the FIR by him against the complainant. The accused-applicant has registered an FIR at Case Crime No.254 of 2018, under Sections 452, 323, 504 IPC and thereafter, the present FIR came to be registered. He further submits that allegations made in the FIR and in the statement of the prosecutrix recorded under Section 164 Cr.P.C. are not convincing and false. Accused-applicant is in jail since 8.7.2020.
Learned AGA has opposed the prayer for bail, but not disputed the aforesaid facts.
Considering the above facts and circumstances of the case, coupled with the contentions raised by the learned counsel for both sides, and without entering into the merit of the case, the applicant is entitled to be released on bail.

(ii) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him under Section 229-A of the Indian Penal Code.
