Petitioner is permitted to correct the description of respondent no.5 in the array of parties in the petition.
Following orders were passed in the matter on 14.5.2018:-
"Petitioner is permitted to implead Additional Director (Pension), Gorakhpur Region Gorakhpur as respondent no.5. Notice on behalf of newly impleaded respondent is accepted by learned Standing Counsel.
Grievance of the petitioner is that though he has retired on 31.3.2016, but his retiral benefits have not been released.
Sri Arun Kumar, learned counsel for the respondent nos.3 and 4 states that amount of insurance has already been credited to the account of petitioner and a statement is made that his GPF amount would be released within ten days. It is also stated that pension papers have been received in the office of Additional Director (Pension), Gorakhpur Region, Gorakhpur on 3.5.2018.
Sri Arun Kumar, learned counsel for the respondents shall make a fresh statement with regard to release of amount due to petitioner towards retiral benefits.
Sri Vivek Rai, learned Additional Chief Standing Counsel may obtain instruction from respondent no.5 about the outcome of petitioner's pending claim. Put up as fresh on 28.5.2018."
Sri Arun Kumar, learned counsel representing the District Basic Education Officer submits that retiral benefits of petitioner were initially not processed as charge was not handed over by the petitioner to the authorities. It is stated that amount of GPF has been transmitted to the account of petitioner on 17.5.2018 and his pension papers have been forwarded to the Additional Director (Pension), Gorakhpur Region Gorakhpur, which is likely to be released shortly.
Learned counsel for the petitioner submits that petition has also not been paid his salary between 1980 to 1983. In respect of clam of salary of petitioner between 1980 to 1983, it is stated by Sri Arun Kumar that claim itself is grossly barred by latches and even details have not been furnished by the petitioner of the claim in that regard.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondents to ensure release of pension, within a period of three months from the date of presentation of certified copy of this order. Petitioner shall also be at liberty to raise his claim with regard to payment of salary between 1980 to 1983, and if such details are furnished to the authorities, the respondents shall have it examined and an appropriate order would be passed within the same period.
