Petitioner was initially appointed on the post of Tracer in 1980. He was subsequently promoted to the post of Clerk in 1992, but the order of promotion was subsequently set aside. Against the order setting aside his promotion, petitioner had filed a writ petition no.8760 of 1993, in which an interim order was granted and the petitioner continued. Ultimately the writ petition was dismissed in default in 2012. Petitioner has also superannuated. A representation has been filed by the petitioner stating that since benefit of promotion has not been granted to him, the authorities ought to consider petitioner's claim for grant of ACP, in terms of applicable scheme. Since this representation has remained pending, and has not been decided so far, the petitioner has approached this Court.
Learned Standing Counsel submits that grievance of petitioner shall be examined, in accordance with law.
Considering the above, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration to petitioner's plea for grant of promotion in terms of applicable scheme, and in accordance with law, by means of a reasoned speaking order, within a period of three months from the date of presentation of certified copy of this order.
