Heard learned counsel for the petitioner and learned Standing Counsel appearing for the respondents.
The petitioner is working as Class-IV employee in the office of respondent no.3-District Probation Officer, District Budaun. The wife of the petitioner, namely, Smt. Guddi Devi fell seriously ill and petitioner admitted her in an hospital and spent Rs.34,658/- regarding medical treatment of his wife.
The petitioner submitted said medical bills for reimbursement to the respondent no.3, who vide letter dated 20/21,8.2019 sought verification from the Chief Medical Officer regarding the medical bills submitted by the petitioner. On which, Chief Medical Officer verified the medical bill for Rs.34,658/- and remitted the same to the respondent no.3 for further action. Thereafter, respondent no.3 vide letter dated 28.05.2020 made request to the respondent no.2-Director, Women Welfare, U.P. Lucknow to provide fund to make payment with respect to claim of the petitioner. Thereafter, in this respect, petitioner made several applications to the authorities concerned, but the same remain unattended and respondent no.2 is sitting tight over the matter.
The grievance of the petitioner is that despite the fact that medical bills submitted by him though has been certified by the Chief Medical Officer, but the respondent no.2 has not released the reimbursement amount.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to competent authority to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondents no.2-Director, Women Welfare, U.P. Lucknow along with a copy of this order downloaded from the official website of High Court, Allahabad, raising all his grievances within a period of two weeks from today. In case, any such representation is filed by the petitioner, the respondent no.2 shall consider and decide the same strictly in accordance with law, by a reasoned and speaking order, preferably within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
