Pursuant to a scheme of National Government called "Rastriya Parivarik Labh Yojana" the head of the family whose income is below the poverty line, upon his death the member of his family would be entitled to Rs. 30,000/- lump sum as benefit to the family under the said scheme. From 1st January, 2016 the applications were required to be filed online but prior to that from the scheme it appears that the same was applicable since 3rd September, 2013. The petitioner's husband who is stated to be head of the family unfortunately died on 4.4.2014. The petitioner filed an application on 25.9.2014 before the District Social Welfare Officer, but the said application was not filed online as filing of application online came to be implemented from 2016 and the petitioner's application is of 2014.
It is submitted that the said application has remained pending and no orders has been passed. The competent authority in this case is District Social Welfare Officer.
The writ petition is disposed of with the direction that the District Social Welfare Officer, Bareilly will consider the claim of the petitioner and pass appropriate orders in accordance with law after due inquiry, as far as possible, within three months from the date a certified copy of this order is presented before it.
