Heard Sri Yadvesh Yadav, learned counsel for the petitioner and Sri Mata Prasad, learned Standing Counsel appearing for the State-respondents.
The petitioner, who is working as Health Education Officer, seeks to assail the order dated 30.10.2019 passed by the Chief Medical Officer, Deoria in terms of which he has been transferred from Community Health Centre, Salempur to Primary Health Centre, Bhatni on the same post.
Counsel for the petitioner does not dispute the fact that the petitioner holds a transferable post and that the order of transfer has been passed by the competent authority as per the procedure. Transfer being an exigency of service, the order of transfer does not call for any interference.
At this stage counsel for the petitioner makes a prayer that he may be permitted to submit a representation before the authority concerned raising his grievances. Counsel for the petitioner undertakes that the petitioner would join his place of transfer.
Needless to say that in case the petitioner joins his place of posting, any representation which may be filed by him raising his grievances may be considered by the authority concerned.
With the aforesaid observations the writ petition stands disposed of.
