Heard learned counsel for the petitioners and perused the record.
In view of the order proposed to be passed, notices need not issue to the private-respondents.
The petitioners are before this Court for a direction to the Additional Civil Judge (Junior Division)-II, Jaunpur to decide the Original Suit No. 1185 of 1991 (Ganesh Vs. Jhilu & Others) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Additional Civil Judge (Junior Division)-II, Jaunpur to consider and decide the aforesaid suit in accordance with law expeditiously and positively within a period of one year from the date of production of copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
