This writ petition has been filed by the petitioner seeking direction to the police authorities to conduct fair and proper investigation in respect of Crime No. 183 of 2017 for the offence under Sections 498-A and 304-B of I.P.C., read with Section 3/4 of Dowry Prohibition Act, P.S. Mehnajpur, District Azamgarh.
According to the petitioner, on 15.9.2017, he lodged the report against the accused persons under Sections 498-A and 304-B of I.P.C., read with Section 3/4 of Dowry Prohibition Act, but nothing has been done against the accused persons.
In Criminal Misc. Writ Petition No. 2887 of 2018, directions were given by this Court for completion of the investigation but even then the police did not bother and has decided to close the case. On a protest petition filed by the petitioner, on 2.7.2018, learned Magistrate has passed the order but till date nothing has been done by the police.
State counsel submits that he has no objection if direction is issued for completion of investigation if already not completed.
The present petition is disposed of directing the police authorities to complete the investigation if already not completed in accordance with law within two months from the date of receipt of a certified copy of this order.
The petitioner is obliged to produce a copy of this order before the Investigating Officer and also before the SP, Azamgarh and in turn, it is expected from the authorities to look into the matter and do the needful.
