Heard Sri R.C. Upadhyay, learned Senior Counsel assisted by Sri Rajan Upadhyay, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
Petitioner is assailing the tentative seniority list published/notified on 30 April 2019, pursuant to decision rendered by the State Public Services Tribunal, Lucknow, in Arvind Kumar Singh Vs. State of U.P. and another (Claim Petition No.1137 of 2013).
Learned Senior Counsel, on instructions, submits that petitioner shall be satisfied, if, a direction is issued to the first respondent to consider and decide the objections, in accordance with law, before finalising the seniority list.
Learned Standing Counsel submits that the first respondent shall pass appropriate order, on the objections of the petitioner, provided the seniority list has not yet been finalised.
In view thereof, on consent, the petition is disposed of directing the first respondent-Principal Secretary, Agriculture, Civil Secretariat, Lucknow, to consider and decide the objections of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
