THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING, THIS DAY, NARENDRA PRASAD J., MADE THE FOLLOWING:
ORDER The petitioner herein filed an application before the Central Administrative Tribunal (‘Tribunal’ for short), Bengaluru Bench, Bengaluru in O.A.No.135/2019, challenging the memorandum dated 18.08.2016, whereby respondent herein has initiated departmental enquiry against the petitioner in violation of Rule 20 of Central Civil Services (Conduct) Rules, 1964 and he also sought for interim relief.
2. On 05.02.2019, the Tribunal, after hearing the petitioner, issued notice to the respondents and directed to post the matter on 02.04.2019. The Tribunal has not rejected the interim prayer sought for by the petitioner.
3. In view of the above, we do not find any error in the order passed by the Tribunal.
4. Since the matter is pending before the Tribunal, we direct the Tribunal to consider the interim prayer and pass appropriate order in accordance with law on 02.04.2019 or on any other convenient date.
5. With the above observations, writ petition stands disposed of.
