Heard Sri A.K. Srivastava, counsel for the petitioners and Sri Vikash Chandra Tripathi, learned Standing Counsel for the respondents.
After some arguments, counsel for the petitioners confined his prayer only to the effect to direct the appellate court to decide the pending appeal being Misc. Appeal No. 05 of 2020 expeditiously.
Heard counsel for the parties and perused the records.
With the consent of counsel for the parties, the present petition under Article 227 of the Constitution of India is disposed of finally directing the court below to decide the pending Misc. Appeal No. 05 of 2020 if possible, on the next date fixed in the matter i.e. 22.02.2021. In case, on the said date on account of any reason, the said appeal could not decide, the court below will decide the same expeditiously and preferably within a period of one month thereafter.
