Heard Sri Ashok Pandey, learned counsel for the petitioners and Ms. Subhra Singh, learned Standing Counsel for the State respondents.
By the impugned order dated 29.06.2018, the Designated Authority, District Jhansi has passed an order suspending the Food License of the petitioner with immediate effect till further orders invoking the provisions under the Regulation 2.1.8(4) of the Food Safety and Standards (Licensing and Registration of Food Business) Regulations 2011.
Ms. Subhra Singh, learned Standing Counsel representing the State respondents pointed out that the petitioner has remedy of filing an appeal against the order of suspension under section 32(4)(c) of Food Safety and Standards Act, 2006 before the Commissioner of the Food Safety.
Learned Counsel for the petitioner states that petitioner has already preferred an appeal on 19.07.2018, copy whereof has been filed as Annexure-5 to the writ petition.
We have perused the same. Whatever may be worth of the document submitted by the petitioner referred to above, the Commissioner Food Safety may take an appropriate decision on the same, whether or not it could be treated as an appeal or mere representation, within a period of four weeks from the date of production of a certified copy of this order.
Petition is disposed of.
