Heard Shri S.K. Pandey, learned counsel for the petitioner and Shri P.K. Chauhan, learned Standing Counsel for the State respondents.
The petitioner is before this Court with request to issue direction to the third respondent, Chief Development Officer, Gorakhpur to conclude the enquiry within stipulated time and cancel the illegal ration cards, which were issued in favour of respondent nos.7 and 8.
Learned counsel for the petitioner states that on the complaint made by the petitioner, the cognizance has already been taken by the Joint Development Commissioner, Gorakhpur on 24.2.2018 and requested the Chief Development Officer, Gorakhpur to finalise the proceeding.
Learned Standing Counsel fairly states that in case the matter is still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the third respondent, Chief Development Officer, Gorakhpur to finalize the proceeding after giving opportunity of hearing to the respondent nos.7 and 8 within a period of three months from the date of production of a certified copy of this order before him.
