THE HON’BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No. 9182 of 2014 Between:
Gandu Venkataiah @ Venkatesh, S/o. Anthaiah .. Petitioner (Accused No.1 in Cr.No.150/2014 of Pargi P.S.) AND The State of Telangana, rep. by the Public Prosecutor, High Court at Hyderabad.
Respondent Petition under Sections 437 & 439 of Cr. P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in connection with FIR.No. 150 of 2014 on the file of Pargi Police Station, for offence under section 354(A), 323 of IPC.
The Petition coming on for hearing upon perusing the petition and grounds filed herein and upon hearing the arguments of Sri N.Krishna Sumanth, Advocate for the Petitioner and of the Addl. Public Prosecutor for the Respondent, the Court made the following ORDER:
“ This Criminal Petition is filed by A.1, under Sections 437 and 439 Cr.P.C., seeking bail in connection with Crime No.150 of 2014 of Pargi Police Station, Ranga Reddy District, which was registered for the offences punishable under Sections 354(A) and 323 IPC.
The averments in the remand report would show that on 06.06.2014 at 10.00 hours while L.W.1 was sleeping in her house, the accused is alleged to have come there, woke up her, and dragged her into a room. When she raised hue and cry, the accused is alleged to have caught hold of her tuft, kicked on her buttocks, fell her down, and thereafter, dragged her, resulting in causing bleeding injuries to her. On the same day at about 2.00 p.m. L.W.1 informed about the incident to L.W.2 who went and questioned the accused about his behaviour. On this, the accused is alleged to have beat him with hands on his face with the help of A.2.
Heard learned counsel appearing for the petitioner and learned Additional Public Prosecutor appearing for the respondent-State.
The learned counsel for the petitioner submits that the allegations in the report are false and they are invented for the purpose of the case. According to him, the petitioner is none other than the agnate of the informant, and due to political disputes between them, the present case has been filed.
The material on record also discloses that the entire investigation is over. Having regard to the facts and circumstances of the case and since the accused is in jail since 14.07.2014, I am inclined to grant bail to him on certain terms and conditions.
..2..
Accordingly, the Criminal Petition is allowed. The petitioner shall be released on bail in Crime No.150 of 2014 of Pargi Police Station, Ranga Reddy District, on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Pargi, Ranga Reddy District.
