JUDGMENT / ORDER

THE HONOURABLE SRI JUSTICE R. KANTHA RAO WRIT PETITION No.33021 of 2014 Dated: 20.11.2014 Between:
Gandam Mahender And … Petitioner The Telangana Genco, Rep.by its Managing Director, Vidyut Soudha, Hyderabad and three others … Respondents THE HONOURABLE SRI JUSTICE R. KANTHA RAO WRIT PETITION No.33021 of 2014
ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader for the respondents.
The petitioner’s land of an extent of Ac.0.06 cents covered by Survey No.1213 of Chelpur village, Mulugu (Ghanpur) Mandal, Warangal District was acquired for the purpose of Kakatiya Thermal Power Project. The Government has decided to provide employment to the land-losers and in that regard a GO was also issued allocating certain posts under land-losers quota. Subsequently a notification dated 22.04.2013 for filling up the posts of security guards and firemen was issued. The version of the petitioner is that on the date of notification he was not aware of the quota allocated to land-losers and therefore he made an application as a general candidate, but as per the notification, certain vacancies were earmarked for land-loser category with a requirement that a candidate claiming under land-loser category have to submit Land-loser Certificate and also No Earning Member Certificate. Thereafter the petitioner applied for the revenue authorities and obtained the aforesaid certificates. According to the petitioner, the revenue authorities took considerable time for issuing the certificates and therefore he could not apply within time for the posts under land-losers quota in response to the notification dated 22.04.2013. Petitioner filed the present writ petition seeking to consider his case for appointment as Security Guard or Fireman under land-losers quota. Learned standing counsel for respondents 1 to 3 submits that so far the selection process has not been finalized and subject to the availability of the vacancy, the case of the petitioner would be considered if he satisfies the eligibility criteria.
In view of the above, the writ petition is disposed of and the third respondent is directed to examine the certificates of No Earning Member and Land-losers produced by the petitioner and on being satisfied about the genuineness of the certificates, he is further directed to consider the case of the petitioner for appointment to the aforesaid posts under land-losers category subject to the eligibility as per the rules governing the appointment. No order as to costs. Miscellaneous petitions pending if any in this writ petition shall stand dismissed.
