(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the post death rituals of his uncle, who has died on 23.02.2012.
Pursuant to the earlier order passed by this Court dated 23.03.2012, the learned APP Shri Pandya, has submitted based on the report which he has received from the Superintendent of Police, Mehsana, that the cause mentioned in the application is genuine.
From the jail remarks, we find that whenever the applicant-convict was enlarged on temporary bail on the earlier occasions, he has surrendered with the jail authority in time.
Considering the totality of the facts, it is ordered that the applicant convict shall be released on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs.5000 with one surety of like amount with the further direction that he shall surrender to the jail authority on expiry of the period.
Application allowed to the aforesaid extent. Rule made absolute accordingly.
