1. Present application has been preferred by the applicants herein - original appellants for fixing the early date for admission hearing and Second Appeal (Stamp) No.37 of 2005 along with Civil Application (Stamp) No. 815 of 2005.

Considering the fact that main Second Appeal (Stamp) No.37 of 2005 as well as Civil Application (Stamp) No. 815 of 2005, are already dismissed for non-prosecution, for which the applicants have already preferred Misc.Civil Application No. 391 of 2012 for restoration, wherein Rule has been issued, which is made returnable today, no relief can be granted to the applicants in the present application unless and until the main Second Appeal and Civil Application for stay are restored to file. Under the circumstances, present application is dismissed.
