COMMON ORDER:
A.S.No.2 of 2005 arises out of judgment and decree, dated 23.07.2004, in O.S.No.42 of 1999 on the file of the learned Principal Senior Civil Judge, Nellore.
ASMP.No.1233 of 2014 is filed by the respondents in the appeal for dismissing the appeal by recording compromise between the parties. Along with this application, the respondents filed memorandum of compromise signed by both the appellants as well as all the respondents.
At the hearing, the appellants and respondent Nos.2 and 3 are personally present. Special Power of Attorney executed by respondent No.1 in favour of respondent No.3 is filed. Respondent No.1 has also filed an affidavit referring to the Special Power of Attorney.
Sri P.Sridhar Reddy, the learned counsel for the respondents, stated that respondent No.3 is representing respondent No.1. All the parties present in the Court have stated that they have entered into memorandum of compromise out of their free will and consent. In pursuance of the said memorandum of compromise, the learned counsel for the respondents in the appeal has handed over two Demand Drafts for a total sum of Rs.3 lakhs to the appellants.
In the light of the above memorandum of compromise, the appeal is dismissed in terms of the said memorandum of compromise. ASMP.No.1233 of 2014 is, accordingly, disposed of.
