It is submitted that in spite of order dated 28.10.2010 passed in Special Civil Application No. 13448 of 2010 and specifically what was directed in para 8 to para 8.6 of the above orders, learned Civil Judge referred to arguments of learned Advocates appearing for the parties and has reproduced the order VII, Rule14 and without considering the issues raised therein and contrary to the directions contained in above paragraphs, the order impugned is passed.
Considering the above, issue notice to respondents returnable on 11th October, 2012. Direct Service is permitted. Meanwhile by way of D.S. Adinterim relief in terms of para 13(C) shall continue till then.
