(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) If the amount is already deposited and the proceedings of First Appeal are concluded, there should not be impediment on the part of the reference court to make payment as per the judgment and award of the trial Court to the original claimants unless any stay order is passed by competent court or higher court.
In view of the above, Mr.Raval, learned advocate for the applicants, seeks permission to move the reference court for seeking disbursement of the amount. Permission granted. Disposed of accordingly. Direct service permitted.
