JUDGMENT / ORDER

HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.40977 of 2014 Date:31.12.2014 Between:
Gali Narayanappa, S/o Venkatappa . Petitioner And:
The State of A.P., reptd by its Secretary, Civil Supplies Department, Hyderabad and three others.
. Respondents Counsel for the Petitioner: Ms Hema Latha Counsel for the Respondents: AGP for Civil Supplies (AP) The Court made the following:
ORDER:
This Writ Petition is filed for a Mandamus to set aside proceedings, vide Rc.No.625/2014E, dated 15.07.2014, of respondent No.3.
On a perusal of the impugned order, this Court is prima facie satisfied that the charges on which the petitioner’s fair price shop authorization has been suspended are not serious enough warranting such suspension. Considering the fact that the petitioner has approached this Court more than five months after passing of the order of suspension and the enquiry is pending before respondent No.3, I decline to interfere with the impugned order. However, respondent No.3 is directed to hold the enquiry by following the procedure explained in B.Manjula Vs. District Collector, Civil Supplies, Kur nool (Writ Petition No.32713 of 2011, dated 26.11.2014) (a copy of the order is enclosed) and pass a final order within one month from the date of receipt of a copy of this order.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.51327 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
31st December 2014 DR JUSTICE C.V.NAGARJUNA REDDY
