Gajulapalli Sreenivasulu Reddy, S/o.Ramasubba Reddy, Hindu, aged about 54 yrs, Occu : Cultivation, R/o.Reddy Nagar, Porumamilla Village and Mandal, Kadapa District .. Petitioner And The State of Andhra Pradesh, Rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad, & 2 others .. Respondents This Court made the following :
THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.37168 of 2014 ORDER :
The case of the petitioner is that he has executed an agreement in favour of his daughter on 15.04.2012 at the time of her marriage towards Pasupu Kunkuma, in respect of two storied house constructed in the property falling to his share, in an extent of Ac.0.10 cents which was acquired by way of sale deed dated 05.06.1984. Though it is specifically averred that the document was presented before the Sub-Registrar, Badvel, Kadapa District, (3rd respondent), the 3rd respondent refused to receive, it is not stated as to when it was presented and when such refusal was made. There is a reference to refusal date as 06.08.2014. Whereas 06.08.2014 is regarding the status of land for the purpose of market value assistance which simply discloses the Sy.No.994 as Government land.
2. Having regard to the fact that the petitioner intend to register the document dated 15.04.2012, it is open to him to present the same before the Sub-Registrar. As and when such document is presented before the Sub- Registrar, the Sub-Registrar shall process the same in accordance with Indian Registration Act, 1908 and Indian Stamp Act, 1899. If the Sub-Registrar is not agreeable for registration of the document, he shall pass an order assigning due reasons and communicate the same to the party. Such exercise shall be completed within a period of three weeks from the date of presentation of the document. If there is no impediment in undertaking to register the document, the Sub-Registrar, shall register and release the document.
3. With the above observations, the writ petition is disposed of. There shall be no order as to costs.
4. Miscellaneous Petitions pending, if any, shall stand closed.
