Sri Akhileshwari Dubey, Advocate has filed his Vakalatnama on behalf of the informant, the same is taken on record.
Heard learned counsel for the applicant as well as learned counsel for the informant and learned AGA for the State of U.P and perused the material available on record.
At the very outset, it was submitted by the learned counsel for the applicant that in this case controversy centres around taking and payment of Rs.72,000/- which money has been handed over by the applicant to the informant side. The submission has been accepted by the counsel for the informant, Sri Akhileshwari Dubey appearing for the informant. The applicant is languishing in jail since 4.8.2018.. The applicant undertakes that if he is admitted to bail, he will neither abscond nor misuse the liberty so granted to him.
Learned A.G.A. has not disputed the aforesaid facts.
In view of fact that both the parties have settled their controversy/dispute regarding payment, no fruitful purpose will be served if the applicant is directed to remain in jail. Therefore, the applicant is entitled to be released on bail.
Accordingly, bail application is allowed.
Let the applicant - Gajendra Singh involved in Case Crime No.344 of 2018, under Sections – 406, 420, 506 I.P.C., Police Station - Swar, District – Rampur be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
