Petitioner claims to be working as Junior Assistant in District Consumer Forum at Muzaffar Nagar. His wife is also a govt. servant and is posted at Meerut. Petitioner places reliance upon clause 1(d) of transfer policy dated 29.3.2018, as per which, as far as possible husband and wife should be posted at one place. It is also stated that though direction was issued by the Chairman of the State Consumer Forum for petitioner's request to be considered at the time of annual transfer chain, yet, petitioner's claim has not been examined in the annual transfer chain implemented during May/June, 2018. Since petitioner's representations made for his transfer to Meerut, where his wife is working, has not been examined, therefore, petitioner is before this Court.
Learned Standing Counsel submits that petitioner's grievance shall be examined by the authority competent, in accordance with law, at the first instance.
In the facts and circumstances, this writ petition stands disposed of permitting the petitioner to approach respondent no.2 in respect of his grievance, noticed above, alongwith certified copy of this order, annexing all materials in support of his claim, within a period of two weeks from today. In case such a claim is raised, the same shall be examined by the authority concerned and appropriate order would be passed, in accordance with law, within a further period of three months thereafter.
