Heard learned counsel for the parties.
By means of present writ petition, the petitioner is challenging the order dated 27.02.2012, passed by the Deputy Labour Commissioner, Lucknow Region, Lucknow, by which penalty of Rs.20,000/- has been imposed on the petitioner for engaging a child labour.
The submission of learned counsel for the petitioner is that there was no child labour working in the establishment of the petitioner and without appreciating his reply, the impugned order dated 27.02.2012 has been passed thereby imposing penalty of Rs.20,000/- on the petitioner.
Taking into consideration the facts and circumstances of the case, the operation and implementation of the order dated 27.02.2012, contained in Annexure-5 to the writ petition, is hereby stayed till further orders of the Court subject to deposit 50% of the recovery amount before the Deputy Labour Commissioner, Lucknow Region, Lucknow, within a period of one month from today.
Learned Standing Counsel prays for and is granted four weeks' time for filing counter affidavit. Rejoinder affidavit, if any, be filed within a week thereafter.
