Heard learned counsel for the petitioners and learned Standing Counsel for the opposite parties.
The submission of the petitioners' counsel is that the petitioners are also entitled to the benefit of the order dated 15.06.2010 passed by this Court in Writ Petition No.4037 (S/S) of 2010 which has been passed in respect of similarly placed persons, who have been transferred by the impugned transfer order (Annexure no.1 to the writ petition).
Learned State Counsel could not show any ground to distinguish the case of the petitioners with the petitioners of the said writ petition.
In view of this, it is provided that further operation and implementation of the transfer order dated 29.05.2010 (Annexure no.1 to the writ petition), so far as it relates to the petitioners, shall remain stayed, till the next date of listing, provided the new incumbents have not joined on the post of the petitioners.
Two weeks time is allowed to the learned standing counsel to file counter- affidavit. Rejoinder-affidavit, if any, may be filed within a week thereafter.
